Terms of Use

1. About these terms

These Terms of Use ("Terms") are an agreement between you and Limbiq3D ("we", "us", "our") and govern your use of the Limbiq3D iOS application (the "App") and the website at limbiq3d.com (the "Site"). By downloading, accessing or using the App or Site, you agree to these Terms. If you do not agree, do not use the App or Site.

2. Licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, in accordance with these Terms and the Apple App Store Terms of Service. You must not copy, modify, reverse engineer, or distribute the App except as permitted by law.

3. Intended use and clinical disclaimer

Limbiq3D is a 3D scanning and measurement tool intended to assist qualified professionals in prosthetics, orthotics and related workflows.

  • The App is not a substitute for professional clinical judgement. Decisions about diagnosis, treatment, device design and patient care remain the sole responsibility of the treating clinician.
  • Scans, measurements and exported models are provided as tools and must be independently verified by a qualified professional before being relied upon for clinical use or fabrication.
  • Limbiq3D is not represented as a medical device and is not intended to provide medical advice, diagnosis or treatment.
  • You are responsible for using the App in compliance with all laws, professional standards and regulatory requirements that apply to your practice.

4. Eligibility

The App is intended for use by professionals in a clinical or fabrication setting. By using the App you confirm you are at least 18 years old and are using it for its intended professional purpose.

5. Purchases, exports and subscriptions

  • Viewing, measuring and enhancing scans are free. Exporting a scan requires a purchase.
  • Purchases and subscriptions are made through the Apple App Store and are subject to Apple's terms. Apple processes all payments; we do not handle your payment details.
  • We offer per-scan export unlocks and auto-renewing subscriptions. Subscriptions renew automatically through your Apple ID until cancelled. You can manage or cancel subscriptions in your Apple ID settings.
  • Refunds for App Store purchases are handled by Apple in accordance with Apple's policies and your rights under the Australian Consumer Law.

6. Your content

You retain ownership of the scans, models and other content you create with the App ("Your Content"). When you voluntarily submit Your Content to us (for example, by attaching a scan to a bug report), you grant us a limited licence to store and use it solely to investigate and resolve the issue you have reported. We handle Your Content in accordance with our Privacy Policy.

7. Acceptable use

You must not use the App or Site to break any law; infringe anyone's rights; upload malicious code; attempt to gain unauthorised access to our systems; or use the bug-report or contact features to send unlawful, abusive or spam content.

8. Intellectual property

The App, the Site, and all associated software, content and branding (excluding Your Content) are owned by us or our licensors and are protected by law. These Terms do not transfer any of our intellectual property to you.

9. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

For major failures you are entitled to a replacement or refund and to compensation for any other reasonably foreseeable loss or damage. For failures that do not amount to a major failure, you are entitled to have the problem rectified within a reasonable time.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, and subject to section 9 (Australian Consumer Law):

  • The App and Site are provided "as is" and "as available". We do not warrant that they will be error-free, uninterrupted, or that scans and measurements will be accurate or fit for any particular clinical purpose.
  • We are not liable for any loss or damage arising from reliance on scans, measurements or exports that have not been independently verified by a qualified professional.
  • Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
  • We are not liable for indirect, incidental or consequential loss to the extent permitted by law.

11. Suspension and termination

We may suspend or terminate your access to the App or Site if you breach these Terms or where reasonably necessary to protect our users or systems. You may stop using the App at any time.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

13. Changes to these terms

We may update these Terms from time to time. The current version will always be available at limbiq3d.com/terms, with the "last updated" date shown above. Your continued use after changes take effect constitutes acceptance of the updated Terms.
